General Terms and Conditions of Delivery
All products are shipped via appropriate channels such as postal & courier services. The insurance of the products is in the hands of the carrier. Claims for damage must be submitted directly to the carrier with supporting evidence. Damage payments are provided by the carrier. Force One and subsequently all its legal representatives are not liable for anything that occurs after the product is in the hands of the carrier.
1. Terms of Delivery

1.3 These general terms and conditions apply to all agreements concluded between Force One and third parties (hereinafter: 'buyer') via the Force One website (email) or by telephone (hereinafter: 'the website'). Dutch law applies to the conclusion and settlement thereof. By placing your order you agree to these general terms and conditions.
1.4 Force One submits to the Advertising Code Committee.
1.5 Delivery is exclusively to private individuals, companies must register separately and will receive different treatment.
2. Purchase agreement
2.1 a. Quotations and offers from Force One can only be accepted as shown on the website or by e-mail. All statements of prices, specifications and/or other indications of items and/or services are carefully displayed by Force One on the website. However, Force One cannot guarantee its accuracy. Force One is not bound to orders placed on the basis of incorrect information on the website.
b. Certain references on the website may refer to information sources offered and maintained by third parties. Force One has no control over this and accepts no liability as a result of the information provided by third parties.
2.2 Agreements are concluded upon confirmation by Force One of the placed order. This confirmation follows as soon as possible after receipt of the electronic order form sent by the buyer in accordance with the ordering procedure stated on the website. Upon conclusion of the agreement, the buyer's payment obligation commences. By sending the order form, the buyer declares that he has taken note of and agrees to the General Terms and Conditions of the Force One webshop.
2.3 For all agreements concluded with third parties via the website, Force One only acts as an intermediary and the agreement with the applicable general terms and conditions is concluded directly between the buyer and that third party. If an agreement is not concluded with Force One, but with a third party, Force One will indicate this on the website.

3.Prices
3.1 The prices stated on the website apply exclusively to the delivery of items purchased via the website. The prices stated include VAT and exclude delivery/shipping costs. Delivery is exclusively to private individuals, companies must register separately and will receive different treatment.
3.2 Force One can adjust its prices and rates at any time. Price changes have no effect on agreements already concluded.
4.Delivery
4.1 a. Indication of delivery times on the website, in offers, confirmations and/or agreements is made to the best of our knowledge and based on information provided by suppliers. The stated periods are indicative, but will be observed as much as possible. Exceeding a delivery period does not put Force One in default. Force One cannot be held liable for damage resulting from exceeding a delivery period.
b. If the item ordered by the buyer is not in stock and will not be available in the short term, Force One will inform the buyer of this. If possible, Force One will provide the buyer with an alternative item of at least equal price and quality.
5.Delivery
5.1 The customer must check his address details on the purchase receipt for accuracy. The customer is obliged to report any inaccuracies to the Force One helpdesk no later than 3 working days before the agreed delivery date. Any costs resulting from incorrect address details on the delivery note will be passed on to the customer.
5.2 The website (Force One) indicates for each product whether or not it can be delivered with the offered parcel service. Force One judges the way in which the customer's order is delivered.
5.3 [ENGLISH] Force One reserves the right to deny any order outside of the Netherlands, in case this happens the complete payment will be refunded within 30 days on the bank account given to us by the buyer.
5.4 Delivery is made to the customer's home via the well-known parcel services. The customer cannot specify a preference for the day on which the package should be delivered, nor can the exact delivery time be indicated. The parcel service will only deliver a package if the delivery address is the same as the billing address.
5.5 If the parcel service does not reach the customer at home on the first attempt, another attempt will be made the next day. If the package has not yet been delivered by the parcel service after two attempts, the package will be stored for a maximum of 3 weeks at the collection office in the immediate vicinity of the addressee.
5.6 If the order is delivered by the parcel service, the customer's order will be delivered to the door in the packaging.
5.7 The customer must clear the entrance/passage of the home of obstacles before delivery, in order to prevent damage to the item and/or the customer's property.
5.8 The product will not be demonstrated under any circumstances; the operation of the device is therefore not checked for the customer.
5.9 By signing the delivery note (waybill) of the parcel service, the customer signs for correct and complete delivery. This only applies to insured shipping.
6.Payment
6.1 Payment by the buyer is made in advance, cash on delivery, by iDeal, Mister Cash or VPay, with the (additional) costs being borne by the buyer. Force One is not liable for errors in the execution of the payment order.
6.2 If the buyer does not pay on time, he is in default without further notice of default being required. In that case, the buyer owes Force One the statutory interest from the due date. In the event of late payment, the buyer is also obliged to compensate Force One for reasonable costs incurred for collection (both judicial and extrajudicial), including the costs of lawyers, bailiffs and collection agencies.
6.3 In the event of late payment by the buyer, Force One is automatically and without obligation to pay compensation released from its obligation to comply with the concluded agreement and deliver items ordered by the buyer.
6.4 Ownership of items delivered to the buyer by Force One before receipt of payment will only be transferred to the buyer if the buyer has paid Force One everything he owes to Force One under the purchase agreement. However, the risk regarding the items already delivered is already transferred to the buyer at the time of delivery.
7.Guarantees
7.1 Force One guarantees that the items supplied by Force One meet the requirements of usability, reliability and service life as may reasonably be expected by the parties to the purchase agreement and therefore guarantees the manufacturer's warranty of the item delivered to the buyer. The Force One warranty period applies as determined by the manufacturer of the item in question. Force One or the manufacturer will determine whether the item will be repaired or replaced during that period, based on the manufacturer's terms and conditions.
7.2 No warranty applies in the following circumstances:
a. With regard to normal wear and tear.
b. If the original purchase receipt cannot be submitted, or if it has been altered or made illegible.
c. If the type and/or serial number of the item has been removed, changed or made illegible.
d. In case of improper use (use other than according to the instructions for use or logical instructions for use. Example: Punching bag is for boxing and not for throwing.
e. In case of damage due to intent or gross negligence.
f. In case of external disaster (e.g.: lightning strike, power outage, natural disasters, etc.).
g. If parties other than Force One have carried out repairs or other work on the article without prior permission from Force One.
7.3 The buyer is obliged to investigate with due speed after delivery of the ordered items whether Force One has properly fulfilled the agreement and is furthermore obliged to inform Force One in writing immediately, but no later than within 2 working days after delivery, of any defects found. . If this does not happen, Force One will be deemed to have fulfilled its obligations under the agreement.
8.Dissolution and return
8.1 a. The buyer has the right to terminate the agreement without giving reasons for a statutory period of 14 working days after receipt of the item. We at Force One use a maximum period of 21 days for your convenience. The buyer must notify Force One of the termination by telephone or email. Our Helpdesk 070-3625800, an email option exists on the "Contact" page. In the event of cancellation, the item must be returned to Force One immediately and responsibly (i.e. with as little risk of damage as possible).
b. The costs for returning the order must be paid by the buyer. The buyer must pay the costs for delivery and collection by the parcel service to the parcel service.
c. After the buyer has appealed for cancellation and the order has been returned, the amount owed to the buyer will be refunded within 30 days. Refunds will be made to the bank or giro account specified by the buyer.
8.2 The claim for reimbursement is subject to the following conditions:
a. The items are unused, complete and undamaged.
b. The original packaging of the items is undamaged (if the buyer requests the deliverers to unpack and/or install the device, the right of return will lapse).
c. Any seals are intact.
d. The buyer can provide the original purchase invoice.
e. Shipping and return costs are borne by the buyer, provided there is a money-back guarantee. In the case of a return package, the amount will be deducted from the refund amount or there will be an additional payment by the buyer.
9. Complaints and repairs
Force One strives for complete satisfaction of its customers. In the unlikely event that something went wrong or does not meet expectations, the buyer can report his complaint by telephone to the Force One helpdesk, by e-mail at (see "Contact" page or email us at info@forceone.nl ) or send it by post to the attention of 'Force One helpdesk' to our postal address, Spui 214e, 2511 BX THE HAGUE. If the buyer wants to ask Force One to repair the item after commissioning in the event of a defect, Force One will determine how this will be done. Depending on the type of item, the buyer must offer the item as follows: The buyer can present the item for repair, preferably in the original packaging, at our address in The Hague upon presentation of his purchase receipt. If the buyer chooses not to deliver items, the costs and risk of shipping are at his expense. The buyer must always include a copy of the purchase receipt or order confirmation with the item to be sent. Repairing or replacing an item during the warranty period and returning the item are at the expense of Force One. Outside the warranty period, costs will be passed on to the buyer by Force One. Any liability of Force One towards the buyer is limited to a maximum of the amount payable by the buyer to Force One under the agreement. Force One is never liable for damage in the form of loss of turnover or income, reduced goodwill or any other consequential damage.
10.Disputes
We advise the buyer to submit any disputes that cannot be resolved by mutual agreement to the Thuiswinkel Organization. This committee ensures a quick and expert handling, which is also cheaper than a court procedure. The decision of the dispute committee is binding for both parties.
